Syllabus
Obiettivi Formativi
Upon completion of this course students are expected to be able to discuss the historical evolution of public international law, to refer to its main subjects and sources and to be familiar with states’ implementation of international standards as well as the consequences of the breaches of international obligations. Students will be able to critically analyse the main contemporary issues and challenges arising in various branches of public international law, including inter alia, the law of the sea, international human rights law, international humanitarian law and international environmental law.

Students are expected to read the relevant assigned reading materials before each class and to contribute to class discussions. Reference to contemporary challenges faced by the international community will be made and case studies undertaken. This will develop critical thinking skills and combine theory and practice.
Verifica Apprendimento
The exam consists in a oral exam where the student will be required to show that they know and understand the notions and principles of International Law and that they are able to apply them to practical cases brought to their attention. The student is expected to be able to independently analyze the relevant sources of International Law and to use the appropriate technical and legal vocabulary, thus proving that they have acquired the study method and the learning ability for carrying on, also independently, further studies on the subject. For this purpose, both theoretical and case-based practical questions are asked.
The final grade is expressed out of 30. Insufficient preparation, corresponding to a score below 18, will lead to failure to pass the exam. Answering all questions correctly, demonstrating an excellent level of preparation, will lead to the attribution of a score of 30, eventually cum laude/with honors.
In assessing the level of preparation of the student, the following evaluation criteria will be considered: knowledge and understanding of the notions and principles of the subject and ability to apply them to specific cases (65%); appropriate use of the technical and legal vocabulary (25%); ability to analyze and evaluate relevant sources and acquisition of the study method (10%).

Contenuti
The course introduces students to the basic principles of public international law and to the main challenges faced by this discipline today. It examines the origins and foundations of public international law and discusses its subjects and sources. To this end, the course considers the legal personality of states, international organizations, individuals, and sui generis entities. It then focuses on the sources of international law with particular emphasis on customary international law and the law of treaties. The course examines privileges and immunities under international law as well as responsibility for breaches of international legal obligations. The remainder of the course will introduce students to selected themes and issues in international law, including the law of the sea, the United Nations and the law of collective security, terrorism, and international human rights law. The course concludes with an outlook in the role of international law in global governance.

Knowledge and understanding: Students will gain specific knowledge on the most important and challenging international law issues, including in the area of the law of the sea, international human rights law, international humanitarian law and international environmental law. This goal will be achieved through both theoretical classes as well as through the analysis of international tribunals’ case law and subsequent class discussion.
Applying knowledge and understanding: Students will be able to use their knowledge in both a theoretical and practical way and analyse and understand current States and other international law subjects’ conduct. These learning skills will be tested through class exercises and workshops and through the final exam.
Making judgment: Students will be able to understand and analyse in a critical legal way the current issues and phenomena at the global level by referring and relying on the fundamental institutions of international law. Moreover. the analysis of international tribunals’ case law will help them to develop a critical thinking.
Communication skills: Students will learn the specific international law legal vocabulary and will gain appropriate communication skills by studying and analysing legal sources and case law. These communication skills will be tested by way of class discussion, workshops and a final oral exam.
Learning skills: Students, after having studied and understood the fundamental concepts of international law, will develop the first basic tools to access international law careers in the future. This knowledge may be strengthened with the specific courses offered within the international law major. Such courses will be very helpful for those students aiming at pursuing a career within international institutions or international non-governmental organizations active in the human rights field.
